Conveyancing

Settlement is where it all comes together.

Your loan and your conveyancing have to land on the same day. Circle Finance isn't a conveyancer. I can refer you to licensed Victorian conveyancers who look after the legal side of buying, selling or transferring property, so the two run in step.

Closing the circle

A purchase is only finished at settlement.

Getting the loan approved is half the job. The contract, the grants and duty, and the transfer of title all have to be right, and on time.

I look after the lending. A licensed conveyancer looks after the legal side. With you at the centre, we work to the same dates, so nothing is left waiting on the other.

What a conveyancer looks after.

The licensed conveyancers I refer clients to handle residential and commercial property across Victoria. This is their work, not ours.

Buying

From the contract you are about to sign to the keys in your hand.

  • A review of the contract of sale and Section 32 vendor statement before you sign, with every step explained.
  • Established homes, new homes, off-the-plan, vacant land, units and townhouses, and commercial freehold property.
  • First Home Owner Grant and stamp duty concession paperwork lodged, so you receive what you are entitled to.
  • Settlement arranged with your lender, including FIRB applications for foreign buyers where needed.

Selling

A contract and vendor statement ready when the agent is.

  • The contract of sale and Section 32 prepared for private sale or auction, with auction contracts ready well before the day.
  • Off-the-plan and on-sale contracts.
  • Section 27 statements, which can release your deposit before settlement, often helpful when you are buying again.
  • Settlement and the discharge of your existing mortgage, coordinated with your next purchase.

Transfers and other matters

Property paperwork outside a standard sale.

  • Transferring a title between spouses or partners, parents and children, siblings or other relatives.
  • Subdivisions, partitions and variations of covenant lodged with Land Use Victoria.
  • Caveats, replacement of lost or destroyed titles, nominations and stamp duty refunds.

Where your loan and your conveyancing meet.

Most settlement stress comes from dates that don't line up. These are the ones we watch.

How a referral works.

Simple, optional and only with your permission.

1. Tell me you need a conveyancer
Mention it when we talk about your loan, or choose “A referral to a conveyancer” when you enquire. Earlier is better, ideally before you sign anything.
2. I refer you, with your permission
I only pass on your name, contact details and what you need help with, and only once you say yes.
3. The conveyancer confirms their costs
They explain how they work and what it will cost before you engage them.
4. We work together to settlement
The conveyancing is theirs, under their licence. I look after the lending, and we keep each other updated through to the keys.

About conveyancer referrals.

Does Circle Finance provide conveyancing?

No. I am a lending specialist and Circle Finance is a credit representative. Conveyancing and legal advice come from the licensed conveyancer or lawyer you are referred to.

When should I talk to a conveyancer?

Before you sign a contract of sale, or before an auction. They can review the contract and Section 32 and explain anything that needs attention while you can still act on it.

What does conveyancing cost?

Each conveyancer sets their own fees and must tell you what they are before you engage them. Ask what is included, such as searches and settlement fees.

Do I have to use the conveyancer you refer me to?

No. A referral is entirely optional, and it makes no difference to your loan or how I look after it. If you already have a conveyancer or lawyer, I will work with them.

How do I check a conveyancer is licensed?

In Victoria, conveyancers are licensed by the Business Licensing Authority. You can check a licence on the Consumer Affairs Victoria public register. Lawyers can also do conveyancing.

Circle Finance is a credit representative. We do not provide conveyancing or legal services or advice. Conveyancing is carried out by the licensed conveyancer or lawyer you are referred to, who will confirm their costs with you before you engage them. You are under no obligation to use them, and it does not affect your loan. This page is general information only. Circle Finance Pty Ltd ACN 624 683 245 is a Credit Representative (507534) of BLSSA Pty Ltd ACN 117 651 760, Australian Credit Licence 391237.
